Job Title: National Consultant to Develop a Simplified Version of the Trafficking in Persons (Prohibition) Enforcement and Administration Act, 2015 and to Facilitate Related Training

Background
The United Nations Office on Drugs and Crime (UNODC) is partnering with the National Agency for the Prohibition of Trafficking in Persons and other Related Matters (NAPTIP) in implementing a European Union funded project on “Promoting Better Management of Migration in Nigeria by Combating and Reducing Irregular Migration that occurs, inter alia, through Trafficking in Persons (TIP) and Smuggling of Migrants (SOM) (NGAX41).

The project is funded by the European Union and aims to strengthen the national capacity to better combat TIP and SOM in order to maximize the development potential of migration. This is being achieved through the creation of a coordinated, synergized, and comprehensive response at the national, state, and local level to target both TIP and SOM. As part of this effort, a number of activities are being implemented to expand NAPTIP's capacity in various priority areas in order to improve service delivery, particularly in investigations and prosecution, project management, monitoring and evaluation as well as victim support services.

NAPTIP was established to oversee the implementation of the Trafficking in Persons (Prohibition) Act Enforcement and Administration Act, 2003 (TIPPLEA 2003). TIPPLEA 2003 was amended in 2005 to address certain identifiable gaps including the strengthening of the prosecutorial powers provided by the Act. However, with the changing dynamics and scope of trafficking in persons, the Act again needed to be amended to address new challenges including organ trafficking and to reflect aspects of the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime.

UNODC provided technical support to NAPTIP through the NGAX41 project, for the amendment of the 2003 Act. The amendment Bill was passed by the Senate on 19 March 2014 and by the House of Representatives on 23 September 2014. The President assented to the new Act on 26 March 2015. The new Act is now known as Trafficking in Persons (Prohibition) Enforcement and Administration Act, 2015.

Justification
The structure and language of the 2015 Act is a bit difficult for an ordinary citizen to understand, as it is written in the highly elevated legislative style largely accessible only to persons with legal training. However, most of the people directly affected by the enactment include victims of TIP and members of other vulnerable groups who will find it difficult to understand the Act. There is therefore a need to develop and finalize a simplified version of the Act written in simple and plain English.

This will increase the number of persons who can access its provisions and ultimately its usage. Such a simplified version will also help ensure more effective communication between NAPTIP, its relevant stakeholders within the Law Enforcement Agencies, suspected traffickers as well as victims of TIP. The final draft copy of simplified version to be produced by the consultant will be subject to approval by the management of NAPTIP. In addition, the consultant will be required to facilitate two one-day training sessions based on the approved simplified version of the Act.
 
Duties and Responsibilities
Specific tasks to be performed by the Consultant:

• Draft a report comparing and highlighting differences between provisions in the old and the new Acts;
• Develop a simplified version of the new Act in plain English that can be easily understood by stakeholders and target groups;
• Produce a fact sheet of the above-mentioned simplified version; and
• Facilitate two (2) one-day training sessions for relevant stakeholders on the content of the new Act, based on the above-mentioned note, simplified version and fact sheet.

The main objective of the training referred to above is to ensure that the new provisions of the new Act are well understood by relevant stakeholders who are working with NAPTIP to curb TIP in Nigeria. It is expected that two one-day training sessions is delivered to relevant stakeholders to be identified by NAPTIP to equip them with the knowledge of the provisions of the new Act and to use training methods that will allow the recipients to transfer the knowledge gained to other relevant stakeholders within the TIP/SOM sector in Nigeria.

Institutional Arrangement:

• The consultancy will be executed under the supervision of the Acting Project Coordinator and the National Project Officer, Victim Support, Rehabilitation and Grant Officer of the UNODC project, Promoting Better Management of Migration in Nigeria by Combating and Reducing Irregular Migration that occurs, inter alia, through Trafficking in Persons (TIP) and Smuggling of Migrants (SOM) (NGAX41) and in close collaboration with the designated staff from NAPTIP.

Expected tangible and measurable outputs:
Specific outputs of the assignment are:

Description of output:

• Develop and submit a detailed workplan of all the activities to be carried out;
• Draft a report comparing and highlighting differences between provisions in the old and the new Acts;
• Develop a simplified version of the new Act in plain English that can be easily understood by stakeholders and target groups;
• Produce a fact sheet of the above-mentioned simplified version;
• Facilitate two (2) one-day training sessions for relevant stakeholders on the content of the new Act, based on the above-mentioned note, simplified version and fact sheet;
• Write and submit a final report of the whole assignment.

The consultant upon resumption of duty shall submit a draft workplan which includes the following activities:

• Date for initial Meeting with UNODC;
• Date for initial meeting with NAPTIP;
• Time frame for the development and submission of the simplified version of the Act;
• Time frame for the development and submission a Fact Sheet of the Penal Provision of the new Act in simplified language;
• Time frame for the development and submission of the training material and the training methodology;
• The dates of the two one-day training sessions for stakeholders;
• Date for the submission of the final report.

Indicators to evaluate the consultant's performance:

• Timely and accurate submission of the documents required;
• Substantive and linguistic quality of the documents prepared;
• Delivery of the training to relevant stakeholders;
• Evaluation and approval of the whole activities by UNODC and the Management staff of the National Agency for the Prohibition of Traffic in Persons and Other Related Matters (NAPTIP).

Required Skills and Experience
Education:

• Hold university degree in Law or Criminology.

Experience:

• At least 8 years of professional experience;
• Excellent experience in and knowledge of trafficking in persons and related issues;
• Legal drafting background or a good experience of past similar activities.

Language:

• Fluency in English;
• Working knowledge of some major Nigeria Languages is an advantage.

Remuneration
Successful candidate will be remunerated in an agreed ratio of about six (6) instalments tied to different deliverables as will be stated in the contract.
